Cancellation policy for vacation rentals
In the event that Tenant cancels the reservation for any reason, a $150 cancellation fee will be charged. If the cancellation occurs at least thirty (30) days prior to the Check-In Date and Owner is unable to re-rent the Rental Property by Tenant’s Check-In Date, Tenant will be liable for fifty (50%) percent of the rental costs. If the cancellation occurs less than thirty (30) days of the Check-In Date, all monies paid by Tenant will be forfeited if the Rental Property is not re-rented by the Check-In Date. Owner will make all reasonable efforts to re-rent the Rental Property by the Check-In Date. We encourage you to buy travel insurance at the time of booking in the event you must cancel and forfeit funds. Travelex offers several different types of travel insurance.
Terms & Conditions for Rental Homes
PROPERTY: With all improvements, including Furnishings.
RENT: Rent is paid on the 1st Day of rental period. If the rent is not paid within the first 5 days, the penalty will be of 7% of the price for each day of delay.
DEPOSIT: The deposit will be reimbursed at the end of this contract and after verifying that utilities were paid and the property is not damaged.
The deposit is to guarantee the reservation of the property you have selected.
This deposit is refundable as long as you show up at the property, and you have complied with the period you booked online and for which you signed a contract and accepted the terms and conditions of it.
The deposit guarantees your reservation, in case you do not show up, this deposit will not be refundable because of your failure at showing up.
PETS: Not Allowed
USE AND OCCUPANCY: Tenants may use the property as a private residence only. Tenant may not use the property for any type of business whatsoever. Tenant assumes any liability without limitations for injury, damages, etc. occurring during his occupancy.
PROHIBITIONS: Tenant may not permit the property to be used for:
a) Any activity, which is noisy, offensive or dangerous.
b) Any unlawful or illegal activity.
MOVE-IN CONDITIONS: Tenant has inspected the property and accepts it AS IT IS except for conditions materially affecting the safety or health of ordinary persons or unless expressly noted otherwise in this lease. Tenant will notify Landlord or Agent (Lilian Vogett, Yucatan Best Living Representative) with 48 hours of move-in, in writing, of any defects or damages.
PROPERTY MAINTENANCE:
A) Tenant’s general responsibilities:Tenants at Tenant’s expense must:
1. Keep the property clean and sanitary.
2. Promptly dispose of all garbage.
3. Supply and replace light bulbs.
4. Replace remote given to the tenant
5. Promptly inform Landlord of all needed repairs.
6. Pay electricity and gas on time.
B) Prohibitions: If Tenant installs any fixtures on the property, authorized or unauthorized, such as additional locks, screens, or other fixtures, such fixtures will become the property of the Landlord. Except as specifically permitted by Landlord in writing,
Tenant MAY NOT:
1. Remove any part of the property or any Landlord’s personal property from the property.
2. Remove, change or rekey any lock or remote control.
3. Install or change any fixture without written approval of Landlord.
C) Landlord’s Provisions:
1. General Domestic Garbage Removal Service Costs for entire term of lease.
2. The landlord agrees to provide wifi Internet and cable television for the entire lease.
3. The land lord agrees to provide the payment of water service that is due to normal usage and does not exceeds the $500mxp every two months.
4. - Wifi, Internet, Cable TV, city water.
REPAIRS:
A) Repairs to be made by Tenant: Tenant will pay any repairman the Landlord directs for costs to repair:
1. Any condition caused by Tenant or Tenant’s guests.
2. Damage from any water stoppage caused by Tenant or guests.
3. Damage to Owner’s personal property and furnishings.
4. Minor maintenance (with cost of less than 500 pesos at any time), including drippings, leaks, etc.
B) Repairs to be paid by the Landlord: Landlord will pay cost to repair:
1. Any condition caused by the Landlord or negligence of Landlord.
2. Wastewater stoppage caused by deterioration, breakage, roots, ground condition or faulty construction.
3. Any condition not the responsibility of the Tenant under paragraph 11th and that adversely affects the health or safety of the Tenant.
LIABILITY: The Landlord nor the representative or company is NOT responsible to Tenant, Tenant’s guests or family, for any damages, injury or loss to person or property caused by fire, smoke, leaks, wind, explosion, interruption of utilities, theft, hurricane, robbery, assault, vandalism or condition of property.
ASSIGNAMENT AND SUBLETTING: Tenant may not reassign or sublet the Property without Landlord’s written consent. An assignment or subletting of the Property without Landlord’s written consent is violable by Landlord.
SPECIAL PROVISIONS: This lease is for a term of ________months. Either party may terminate or change the terms of the lease by giving the other party at least 10 days written notice. The owner will charge a deposit penalty fee ($) if the tenant decides to break the lease. If the owner decides to break the lease, the tenant shall receive is deposit back within five (5) days from the last day as tenant.
AGREEMENT OF PARTIES: Entire agreement: This lease contains the entire agreement between Landlord and Tenants and may not be changed except by written agreement.
The terms of this lease are negotiable among Parties. This is intended to be a legally binding agreement upon final acceptance. READ IT CAREFULLY
